What is the PACT Act and how does it affect online vape sales?
The Preventing Online Sales of E-Cigarettes to Children Act (PACT Act) expanded the original PACT Act to cover e-cigarettes and vaping products. Online vape sellers must: register with the ATF and state tobacco tax administrators, verify customer age, comply with state delivery sale laws, and use only shipping carriers that allow tobacco/vape product delivery. Non-compliance creates significant legal and processing risk.
Can I still ship vape products by mail?
USPS is prohibited from delivering vape and e-cigarette products. UPS and FedEx have largely banned vape shipments as well, following the PACT Act expansion. DHL and certain regional carriers still offer vape product delivery in some scenarios. Shipping compliance is a separate issue from payment processing — we handle the latter and can point you to resources on the former.
Do I need FDA approval to sell vape products?
Under FDA's deeming rule, all e-cigarette and vaping products are regulated as tobacco products.
